The sponsor of the drawing is the New Orleans Academy of Ophthalmology, in cooperation with the American Society of Cataract and Refractive Surgery (hereinafter “ASCRS”). Collectively, the foregoing entities are referred to herein as the “Sponsor”. Those qualified individuals who voluntarily participate in the Sponsor’s drawing agree to the contest rules and terms stated herein.
The contest will take place in the exhibit hall of the ASCRS•ASOA Annual Symposium May 9, 2016, to be held at the Ernest N. Morial Convention Center (MCC), in New Orleans, Louisiana (the “Conference”).
Participants who receive a specially-numbered ticket either from a participating Conference exhibitor, or from other sources designated by ASCRS in the exhibit hall, and who complete certain required information on the ticket and drop it into a designated drum will have their tickets entered into a drawing to win one grand prize, consisting of a 2016 Tesla automobile (estimated value $98,200) selected in advance by ASCRS and placed on display at the MCC. In lieu of the automobile, the winner may instead choose a $30,000 cash prize. In addition to the grand prize, there also will be two other prizes (collectively the “preliminary prizes”), consisting of an Apple watch (estimated value $1120) and a hotel suite and limo transfer package for the ASCRS conference in Los Angeles in 2017 (estimated value $5,000).
Eligibility for the drawing is limited to those over the age of 18 who are registered Conference attendees with exhibit hall access and who receive a specially-numbered ticket on the floor of the exhibit hall. A limited number of tickets will be distributed to attendees by participating exhibitors in return for properly completing any questionnaire, survey or other requirement (other than payment) that an exhibitor or ASCRS may set as a condition of receiving a ticket. In addition, NOAO/ASCRS will distribute tickets at its Conference booth to those Conference attendees who have made a $50.00 minimum donation to NOAO to benefit the ASCRS Foundation during the registration process or at the Conference, as well as by filling out the ASCRS Clinical Survey while onsite at the conference.
Sponsor employees, vendors, exhibitors and members of the Press are ineligible to participate. To provide a reasonable chance for all attendees to enter the drawing, no attendee may submit more than five (5) tickets during the course of the Conference. The odds of winning a prize depend upon the number of individuals who participate in the contest. No purchase is necessary to be entered in the drawing, although a voluntary donation of $50.00 or more may be made to NOAO to benefit the ASCRS Foundation as a means of obtaining a drawing ticket from the ASCRS exhibit booth. Those not wishing to make a donation to NOAO to benefit the ASCRS Foundation may obtain a ticket from an exhibitor or by filling out the ASCRS Clinical Survey onsite.
The winning ticket for each of the preliminary prizes will be drawn at the raffle drum located at the rear of the MCC exhibit hall at 4:45 pm on both Saturday, May 7th and Sunday May 8th. (Saturday’s drawing is for the Apple watch and Sunday’s drawing is for the hotel suite and limo transfer package.) The owners of the winning tickets MUST BE PRESENT in person at the raffle drum and must present identification and a matching ticket stub in order to claim the prize. If the winner is not present, tickets will be drawn until a winner who is present at the raffle drum is selected. Preliminary prize winners are responsible for any applicable federal, state and local taxes on their prize. (Preliminary winners continue to be eligible for the grand prize as well.)
The winning grand prize ticket will be drawn at the Tesla booth at the MCC exhibit hall at 4:45 pm on Monday, May 9, 2016. Again, the owner of the winning ticket MUST BE PRESENT in person at the Tesla booth and must present identification and a matching ticket stub in order to claim the prize. If the winner is not present, tickets will be drawn until a winner who is present at the Tesla booth is selected. The winner also must agree to pay any shipping or handling fee associated with the automobile, along with all federal, state and local taxes associated with the Tesla or cash prize.
Additionally, all prize winners must agree to participate in ASCRS marketing photos/videos, social media or printed promotions related to the contest and to give ASCRS an unlimited, royalty-free, perpetual, world-wide license to use the winner’s likeness in all such promotions, regardless or medium or format.
Neither the Sponsor nor anyone involved in administering or providing prizes for the drawing will have liability for (A) technical malfunctions, including those arising from electronic, hardware, software, network, Internet or computer malfunctions, (B) any damages or losses of any kind caused by any acceptance, possession or use of the prize, or (C) inaccessibility or unavailability of Sponsor’s exhibitor floor in whole or in part for any reason.
By participating in the drawing, the winners agree that under no circumstances will Sponsor, its affiliates, and their officers, directors, employees, agents, or licensees (“Released Parties”) be liable for any form of damages arising out of their participation in the Contest, including but not limited to any injuries that winners or others may suffer while driving or being driven in the 2016 Tesla automobile, and winners and their family and heirs further waive any rights to bring any claim against the Released Parties in any forum related to their participation in the Contest.
If for any reason this Contest is not capable of being conducted as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, government regulations, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right to cancel, terminate, modify or suspend the Contest. This contest is also void where prohibited by law, including in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these Contest rules.
